Thank you for visiting this website (this “Site”). These terms, together with our King Games - Terms of Use and our Privacy Policy (collectively, the “Terms”) represent a legal agreement between you and King.com Limited (“King”), a Maltese company with registered office address at Aragon Business Centre Level 4, Dragonara Road, St Julian’s STJ3140, Malta, (company registration number C42504 and VAT number MT1862-2630). These Terms represent a legal agreement and contain important information about your rights and obligations concerning this Site. If you do not agree to these Terms or any future updated version you must not access and/or use, and must cease all access and/or use of this Site. If we require that any future update to these Terms requires any action from you to accept the updated terms, then you may not be able to continue using the Site until you have taken such action. Please note that these Terms do not apply to the purchase of Gift Cards (as defined below), and only apply to redemptions of Gift Cards. Purchases of Gift Cards are subject to separate terms and conditions; you should contact the relevant Reseller (as defined below) for more information. IMPORTANT NOTICE FOR RESIDENTS IN THE USA: THESE TERMS ARE SUBJECT TO BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS AS DETAILED IN PARAGRAPH 21 ON OUR King Games - Terms of Use ("Games Terms").

You can use this Site to redeem your gift card(s) (“Gift Card(s)”) for in-game virtual gold bars (“Gold Bars”) which you have purchased from one of our approved resellers or issuers (“Resellers”) to be used on Candy Crush Saga or Candy Crush Soda Saga (“Game(s)”) subject to complying with these Terms and the terms and conditions of your Gift Card. You acknowledge that you will not receive credits, currency, or any such equivalent as part of redeeming a Gift Card. You expressly acknowledge there is no in-game wallet or credit functionality within the Games. When you redeem a Gift Card, you may (at our sole discretion) also receive free in-game item(s), such as unlimited in-game lives for a specified period of time (such time period to start from when the Gift Card is redeemed and can not be paused and/or postponed), or in-game boosters to use within the Game(s) and/or additional Gold Bars. The selection of which in-game item(s) or the number of extra Gold Bars to be provided is entirely within King’s sole discretion. To the maximum extent permitted by local law, any offers and bonuses may be discontinued or replaced at any time. If we make our Gift Cards available for use in other games, we’ll ensure you’re made aware and give you the option to select the available games. You’ll need to select in which Game you use your Gift Card balance, and you cannot transfer your Gold Bars from one game to another, as your selection on the Site will be final. The Gift Card does not have any monetary value and cannot be exchanged for cash. If you have any doubt about which Resellers are authorized, please contact us. Note that additional terms may apply depending on where you bought the Gift Card from, and it is your responsibility to check any Resellers’ terms that apply in addition to these Terms. To redeem your Gift Card(s), you’ll need to login (if you have an existing King account or via Facebook login within our Games) or create a new account in the Game you select by providing us with your email address and create a password. Once you have your King account in our Game, you’ll need to return to the Site, login with the King credentials and we’ll ask you to provide your Gift Card number and PIN (which will have been provided to you by the Reseller and will be written on your Gift Card) and select the Game you want to use your Gold Bars on. After following all the steps as provided on the Gift Card and the Site, the corresponding amount of Gold Bars will be delivered to the inventory of the King Account that was logged in on the Site when the Gift Card was redeemed. You should then be able to use the applicable Gold Bars directly in the selected Game. Any instructions on how to redeem your Gift Card will be provided on the Gift Card and on the Site, and if you have any questions, please contact us at queries@support.king.com.

A few sections we want to make clear and prominent to you are set out below, which comprise the main requirements for your use of this Site:

11. You must be 13+ to play our Games and use this Site.
12. You may only use this Site and any materials found in this Site (including, but not limited to, any images, logos, designs, insignia, marks, pictures, sounds, text, messages, tools, software, technology, products, files, information, data, demos, promotional materials, audiovisual and multimedia works and any other items or expressions) (collectively, "Materials") in accordance with these Terms and you agree to comply with these Terms at all times.
13. Your account is personal to you, and you are not entitled to transfer your account to any other person.
14. King grants you a non-exclusive, non-transferable license, to access and use this Site for your personal use only. Such license is subject to these Terms and does not include: (a) any commercial use of the Site or the Materials therein; (b) the distribution, public performance, public display, making publicly available, or other unauthorized exploitation of any Materials; (c) modifying or otherwise making any derivative uses of the Site or the Materials, or any portion thereof; (d) downloading (other than the page caching) of any portion of the Site, the Materials or any information contained therein, except as expressly permitted on the Site; or (f) any use of the Site or the Materials other than for their intended purposes. Any use of the Site or the Materials other than as specifically authorized herein, without the prior written permission of King, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws, including without limitation copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms shall be construed as conferring any license to intellectual property rights. King may revoke this license at any time.
15. All right, title and interest in and to this Site, the Materials and all associated proprietary rights are owned by King or its licensors, and no ownership of any of the foregoing items is transferred to you by virtue of these Terms or King's permitting you to use the Site. King reserves all rights in and to the Materials not expressly granted herein.
16. You acknowledge and agree that you shall have no ownership or other property interest in any account that you create using any of our services. We may suspend, terminate, modify or delete any of these accounts at any time for any reason or no reason, with or without notice to you.
17. Subject to these Terms and any other applicable policies, as applicable, you may not: (i) use or transmit any Materials on or to any other website or network; (ii) modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any Materials; (iii) reproduce any Materials other than as specified above; (iv) distribute, license, rent, sell, lease or otherwise transfer any Materials; or (v) remove, obscure or alter any notice of copyright or other proprietary notices present on or in any Materials.
18. You represent, warrant and covenant that: (i) you will comply with all applicable laws, regulations and orders of any governmental authority in your use of this Site and the Materials (including, without limitation, all export control laws, regulations, and orders); (ii) you are not located in, under the control of, or a national or resident of any country to which export of any Materials is prohibited by U.S. law, regulation or order; and (iii) you will not upload or otherwise transmit to this Site any software or other materials that: (a) contain any viruses or other harmful code; (b) violate, misappropriate or infringe any patent, copyright, trademark, trade name, trade dress, trade secret, right of publicity, right of privacy, moral right, right of attribution or integrity or any other intellectual property right or proprietary right (collectively, "Proprietary Rights") of any person or entity; or (c) contain any material that is libelous, defamatory or portrays any person in a false light.
19. Privacy: The data controller for all personally identifiable information or personal data that we collect about you through or in relation to our Games or other Services is King.com Limited. King.com Limited collect, process, use and share your personal information in accordance with our Privacy Policy and as set out in these Terms. By accessing or using the Site or playing our Games, you acknowledge you have read and understood our Privacy Policy; otherwise, you should not use access and/or use our Site or play our Games. 20. Disclaimer of Warranties: THIS SITE AND ALL MATERIALS IN THIS SITE ARE PROVIDED “AS IS” AND ALL USE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KING DISCLAIMS, AND YOU HEREBY WAIVE, ANY AND ALL WARRANTIES AND LIABILITIES OF KING, WHETHER EXPRESS OR IMPLIED, ARISING BY OPERATION OF LAW OR OTHERWISE, WITH RESPECT TO THIS SITE AND ANY MATERIALS IN THIS SITE, INCLUDING, BUT NOT LIMITED TO ANY: (A) IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE; (B) IMPLIED WARRANTY OF NON-INFRINGEMENT; AND (C) CLAIM IN TORT (INCLUDING NEGLIGENCE). WITHOUT LIMITING THE FOREGOING, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU ACKNOWLEDGE THAT KING DOES NOT REPRESENT OR WARRANT THAT THIS SITE WILL BE ACCESSIBLE WITHOUT INTERRUPTION OR THAT THIS SITE, ANY MATERIALS IN THIS SITE, OR THE SERVER THAT MAKES THIS SITE AVAILABLE ARE FREE FROM ERRORS, DEFECTS, DESIGN FLAWS OR OMISSIONS OR FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
21. Limitation of Liability and Indemnity: To the extent permitted by applicable law, in no event will King be liable, whether in contract, warranty, tort, product liability, strict liability or other theory, to you or any other person or entity for any damages (including, without limitation, any indirect, incidental, special or consequential damages) arising out of or in connection with any use of, inability to use or results of use of this Site or any Materials on or in this Site, even if King or its representative has been advised of the possibility of such damages. You agree to defend and indemnify King, its parent, subsidiaries, licensors and affiliates against and from any third-party claims, liabilities, losses, injuries, damages, costs or expenses incurred by King arising out of or from your use of the Site.

23. For residents in the European Union and the United Kingdom: Most concerns can be solved quickly by contacting us at queries@support.king.com. In the unlikely event that we cannot solve your concern and you wish to bring legal action against us these Terms and the Gift Cards shall be governed by and construed in accordance with the laws of England unless prevented by applicable law. If you are resident in a member state of the European Union, you also enjoy the protection of the mandatory provisions of the consumer protection laws in your member state.
24. For residents in the United States: Any claims or requests for relief arising out of these Terms (including interpretation, claims for breach, and all other claims or requests for relief (including consumer protection, unfair competition, and tort claims)) will be subject to the laws of the State of Delaware, without reference to conflict of laws principles. If any court or arbitrator determines that the "Class Action Waiver" paragraph set forth in paragraph 21 of the Games Terms is void or unenforceable for any reason or that an arbitration can proceed on a class basis, then any and all claims arising out of these Terms (including interpretation, claims for breach, and all other claims or requests for relief (including consumer protection, unfair competition, and tort claims)) shall be decided under the laws of the state where you were a citizen at the time you first accessed the Site that was subject to these Terms. You and we irrevocably consent to the exclusive jurisdiction and venue of state or federal courts in Los Angeles County, California to resolve any claims that are subject to exceptions to the arbitration agreement described in paragraph 21 of the Games Terms, or otherwise determined not to be arbitrable. To the fullest extent permitted by law, any claim or request for relief in a demand for arbitration filed pursuant to paragraph 21 of the Games Terms, as well as any claim or request for relief in a lawsuit filed in court under an exception to the arbitration agreement in paragraph 21 in the Games Terms, will be barred if filed more than two (2) years after the date that the claim or request for relief accrued. If the law requires a claim or request for relief be filed earlier than two (2) years after the claim or request for relief accrued, that law controls.
25. If you are a resident outside the United States and you are entitled to commence and/or participate in legal proceedings within the United States, then you agree that you will be bound by the BINDING ARBITRATION AND CLASS ACTION WAIVER provisions in paragraph 21 in the Games Terms.
26. If you are resident outside of the United States, the European Union, or the United Kingdom: Except for paragraph 25, and unless the law of your country of residence states otherwise, the laws of England will govern the interpretation of these Terms and apply to claims for breach of it. If there is a dispute between us regarding these Terms, then that dispute will be subject to the jurisdiction of the courts of England unless the law in your country of residence allows you to choose the courts of that country for the dispute in question.
27. You understand and agree that the Site may not be used, accessed, downloaded, or otherwise exported, reexported, or transferred in contravention of applicable export control, economic sanctions, and import laws and regulations, including, but not limited to, the U.S. Export Administration Regulations ("EAR") and regulations promulgated by the U.S. Department of the Treasury's Office of Foreign Assets Control ("OFAC"). You represent and warrant that you (1) are not subject to U.S. sanctions or export restrictions and otherwise are eligible to utilise the Site under applicable laws and regulations; (2) are not located or ordinarily resident in a country or region subject to comprehensive or near-comprehensive U.S. sanctions/embargo, unless your use of the Site in such country or region is authorised by U.S. law; (3) are not an official, employee, agent, or contractor of, or directly or indirectly acting or purporting to act for or on behalf of, a government (including any political subdivision, agency, or instrumentality thereof or any person directly or indirectly owned or controlled by the foregoing) or political party (e.g., Cuban Communist Party, Workers' Party of Korea) subject to U.S. sanctions/embargo or any other entity in a sanctioned/embargoed country or region or subject to U.S. sanctions/embargo; and (4) will not the Site in connection with an end-use prohibited by U.S. law.
28. Changes to these terms: we reserve the right to update these terms from time to time by posting the updated version at that address. We may do so for several reasons including without limitation because we change the nature of our products or services, for technical or legal reasons, or because the needs of our business have changed. You agree that if you do not accept any amendment to our terms then you shall immediately stop accessing and/or using our Services.
